Santa Clara County Planning Collaborative

A suite of resources to help homeowners navigate the process of developing an Accessory Dwelling Unit (ADU) on their property is now available on a new website, www.aduscc.org, developed by the Santa Clara County Planning Collaborative, a joint initiative of all 16 jurisdictions in the county.  These resources include:

  • The aduscc.org website and free ADU Guidebook that walks through each step of the process, from concept through permitting and construction as well as the basics on being a landlord.
  • ADU Process Overview & Important Information outlines the key steps and things to consider along the way.
  • Local ADU Rules for homeowners to learn about the ADU rules and regulations that apply to them, as well as get contact information for local departments and staff.
  • Sample ADU floorplans and stories from neighbors about what they built.
  • An ADU Glossary with frequently used terms.
  • An ADU Plans Gallery, to launch later this year, will allow homeowners to select from a variety of free and low-cost plans and connect with ADU designers and firms.

The Planning Collaborative is operated under the auspices of the Cities Association of Santa Clara County. The ADU work was made possible by State grant funding received from the Association of Bay Area Governments.

Town Council Meeting – November 21, 2023

At the November 21, 2023 Town Council Meeting, the draft Ordinance was adopted by the Council.  The updated regulations will go into effect on December 22, 2023.

Town Council Meeting – November 7, 2023

At the November 7, 2023 Town Council Meeting, the Council considered and voted unanimously to introduce an Ordinance amending Chapter 29 (Zoning Regulations) of the Town Code regarding accessory dwelling units with specific modifications.  The Town Council motion included a specific modification to not accept the recommendation of the Planning Commission to eliminate parking requirements for accessory dwelling units altogether and to revise the Ordinance to reinstate the parking regulations to Section 29.10.320 (f) as presented to the Planning Commission on September 13, 2023.  The parking regulations in the remain largely unchanged from the current Town Code.  

Planning Commission Meeting - September 13, 2023

At the September 13, 2023 Planning Commission Meeting, the Commissioners reviewed and forwarded a recommendation to the Town Council on amendments to Chapter 29 (Zoning Regulations) of the Town Code regarding Accessory Dwelling Units.  The proposed amendments also correct outdated references to sections of the Town Code Included in sections pertaining to termination of nonconforming use status, requirements for a two-unit development under Senate Bill 9 (SB 9), and Civil Penalties.

Streamlined ADU permitting process

In response to changes in State law, and as part of the Town’s ongoing efforts to increase efficiency for permit reviews, the Planning and Building Divisions have developed a new Building permit application form and process.  Residents who wish to build a new ADU or JADU can now submit a single application form and proceed through a single plan review process in order to obtain their Building Permit. New guidelines and application forms are available in the ADU and JADU Application and through both the Planning and Building Division webpages. If you have questions, please feel free to contact the Planning Division at (408) 354-6874 or Planning@LosGatosCA.gov. ADU Building Permit Application Packet

ADU Ordinance updates were reviewed and approved by Town Council on April 7, 2020, with a second reading on April 21, 2020.  The Town’s current ordinance went into effect on May 21, 2020.  The Town Council staff reports can be found on the Town Agendas and Minutes Page.  This is Approved Ordinance 2307.  Any discrepancy between State law and the Town Code would default to State law.
