NOTICE AND SUMMARY OF ORDINANCE 2333

AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS AMENDING TOWN CODE SECTION 1.10.075, “OFFICIAL TOWN HOLIDAYS – DESIGNATED; EXCEPTIONS” TO ADD JUNETEENTH AS A TOWN HOLIDAY

Notice is hereby given that at its meeting on Tuesday November 1, 2022, the Town Council conducted the first reading of Ordinance 2333 and at its meeting on Tuesday, November 15, 2022, the Town Council adopted Ordinance 2333 by the following vote:

AYES: Mary Badame, Matthew Hudes, Maria Ristow, Marico Sayoc, Mayor Rob Rennie
NAYS: None

The following is a summary of the Ordinance:
Ordinance to amend Town Code section 1.10.075, “Official Town Holidays – Designated; Exceptions,” to add the Juneteenth Holiday to the list of the Town’s observed holidays.

This ordinance shall become effective thirty (30) days following its passage and adoption and this summary shall be published within fifteen (15) days upon passage and adoption

NOTICE AND SUMMARY OF ORDINANCE 2334
AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
AMENDING CHAPTER 29 (ZONING REGULATIONS) REGARDING TWO-UNIT HOUSING DEVELOPMENTS AND URBAN LOT SPLITS IN ALL
SINGLE-FAMILY RESIDENTIAL ZONES

Notice is hereby given that at its meeting on Tuesday November 1, 2022, the Town Council conducted the first reading of Ordinance 2334 and at its meeting on Tuesday, November 15, 2022, the Town Council adopted Ordinance 2334 by the following vote:

The following is a summary of the Ordinance:
Ordinance regarding permanent regulation to comply with the requirements of Senate Bill (SB) 9 that would amend Chapter 29 of the Los Gatos Town Municipal Code to regulate urban lot splits and two-unit housing developments by establishing regulations in the Zoning Code to allow two-unit housing developments and urban lot splits as specified by California Government Code Sections 66452.6, 65852.21, and 66411.7, as adopted and amended by SB 9. “California Senate Bill 9 (“SB 9”) authorized “urban lot splits” and “two-unit housing developments” in single family residential zones. SB 9 requires local agencies to adopt local regulations to implement its provisions. SB 9 provides that local agency review of SB 9 applications must be “ministerial” without a public hearing but does authorize local agencies to apply objective standards. The Town’s proposed ordinance sets forth the objective standards which will be used to review SB 9 applications for “urban lot splits” and “two-unit housing developments” and includes the following elements:

• Limits window size;
• Imposes a required second-story step-back;
• Limits size of first unit;
• Imposes height limitations;
• Imposes grading restriction for grading involving more than 50 cubic yards of dirt excluding driveways and the building footprint;
• Imposes a frontage requirement;
• Imposes requirements for flag lots;
• Imposes a minimum lot size;
• Addresses the calculation of floor area ratio and lot coverage;
• Imposes restrictions on average slope;
• Limits the number of driveways.”

This ordinance shall become effective thirty (30) days following its passage and adoption and this summary shall be published within fifteen (15) days of passage and adoption.

REPEALING AND REPLACING CHAPTER 6, BUILDING REGULATIONS, AND
CHAPTER 9, FIRE PREVENTION AND PROTECTION, AND ADOPTING NEW 2022 CALIFORNIA BUILDING AND FIRE CODES, AS AMENDED, INCLUDING REACH CODES

Notice is hereby given that at its meeting on Tuesday November 1, 2022, the Town Council conducted the first reading of Ordinance 2335 and at its meeting on Tuesday, November 15, 2022, the Town Council adopted Ordinance 2335 by the following vote:

The following is a summary of Ordinance 2335:

Ordinance repealing and replacing Chapter 6, Building Regulations, and Chapter 9, Fire Prevention and Protection, of the Town of Los Gatos Municipal Code with the New 2022 California Building and Fire Codes, and Reach Codes. This ordinance adopts the California Building Code by reference. California Building Code modifications include but are not limited to calculation methods for building allowable area, materials and construction methods for exterior wildfire exposure, emergency escape and rescue openings, energy storage systems, photovoltaic requirements, increased energy efficiency, and increased green building requirements.

Local modifications to the California Building Code include but are not limited to location and use of sprinkler systems within Group R Occupancies, fire and smoke alarm system requirements, Class A roofing materials in all areas of the Town, vegetation management, defensible space elements, fire suppression water supply, limitations of gypsum wall board and cement plaster as structural elements, increased use of EV charging stations and future locations, implementation of all electric construction in both residential and commercial construction, definition of New Construction, and energy storage systems.

This ordinance shall become effective on January 1, 2023.
