NOTICE AND SUMMARY OF ORDINANCE AMENDING PLANNED DEVELOPMENT ORDINANCE 2172
INTRODUCE AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS, BY TITLE ONLY, AMENDING PLANNED DEVELOPMENT ORDINANCE 2172 RELATIVE TO THE MAXIMUM RESIDENCE SIZE ALLOWED ON LOT 14 AND THE MAXIMUM AVERAGE RESIDENCE SIZE ALLOWED IN THE SHANNON VALLEY RANCH SUBDIVISION AND REPEALING ORDINANCE 2172 FOR THE SHANNON VALLEY RANCH SUBDIVISION AT SHANNON AND HICKS ROADS (SHANNON OAKS AND MOUNTAIN LAUREL LANES) ON PROPERTY ZONED HR-5:PD. APN: 567-24-023.
Notice is hereby given that that at its meeting of Tuesday, March 7, 2023, the Town Council conducted the first reading of an Ordinance amending Planned Development Ordinance 2172. The second reading is scheduled for Tuesday, April 18, 2023, at approximately 7:00 p.m., in person and via teleconference.
The following is a summary of the Ordinance:
The Town Council will consider adoption of a Planned Development Ordinance that would amend Planned Development Ordinance 2172 to increase the maximum residence size allowed on Lot 14 from approximately 3,000 square feet to 4,850 square feet, and to increase the maximum average residence size allowed in the Shannon Valley Ranch Subdivision from 4,650 square feet to 4,655 square feet. All other performance standards included in Ordinance 2172 would remain unchanged and in effect. No construction or site development is proposed with this application. A development proposal for construction of a new residence would be processed and reviewed under a future Architecture and Site application. If adopted by the Town Council, Planned Development Ordinance 2172 would be repealed and replaced by the amended Planned Development Ordinance.

NOTICE TO CONTRACTORS
In accordance with and as described and provided in the Contract Documents thereof and the proposed form of contract thereof, all of which are on file in the office of the Director of Public Works of the Town, and which are made a part hereof, electronic bids will be received via the Town of Los Gatos Plan Room at www.losgatosplanroom.com only until 2:00 PM Thursday, April 6, 2023 for the following project:

LOS GATOS CREEK TRAIL TO HIGHWAY 9 TRAILHEAD CONNECTOR PROJECT
Bidders must “register for an account” on the Plan Room to submit bids electronically. Plans and Specifications and Addendums (if any) may be viewed and downloaded free of charge via the internet at the Plan Room. To be included on the Plan Holder’s List for the project, registered users must download the Plans and Specifications from the Plan Room. Bidders must verify and acknowledge all addendums before submitting a bid. Hard copies of the Plans and Specifications will not be provided by the Town of Los Gatos.
The Town will respond, via Addenda, only to questions submitted in writing to the Town and received by the Town a minimum of ten (10) working days prior to the bid opening time and date. Responses to questions received by the Town after this time and date will not be provided.
Bids submitted on the Town of Los Gatos Plan Room shall be opened/downloaded and publicly read live via a Zoom meeting scheduled for April 6, 2023 at 2:00 pm. Please contact Michelle Quinney at MQuinney@losgatosca.gov for the Zoom link to participate.
Scanned electronic copy of a Bidder’s Bond, cashier’s check, or certified check, as required by the Contract Documents, is to be included with each electronic bid. After the bid opening, the original Bidder’s Bond, cashier's check, or certified check from the lowest three responsible bidders must be delivered to the Town of Los Gatos Parks and Public Works Director at 41 Miles Avenue, Los Gatos, CA 95030 and must be received by the Town within 24 hours of the bid opening time and date.
This following information is presented to indicate the size of the project and no warrant is made or intended as to final quantities:
The project, in general, includes clearing and grubbing, tree removal and tree protection, water pollution control and traffic control, providing, installing and constructing a prefabricated bicycle and pedestrian bridge, retaining walls and a pedestrian switchback structure, sidewalk and trail improvements, handrails, guardrails, ramps, fencing, erosion control, utility coordination, inlet and storm drain modifications, signing and striping, AC overlays and pavement widening on and around the Los Gatos Creek Trail and SR 9 in Los Gatos, CA.
All work will occur within existing Caltrans right of way.
This project is funded by federal funds and therefore is subjected to federal guidelines as noted in the Contract Documents. The Contractor shall be responsible for complying with all federal requirements and for completing and submitting all necessary forms required under this contract.
Prevailing Wage and Related Labor Requirements. The contractor will be required to comply with the applicable federal prevailing wage, hour and labor requirements, including those set forth in the Davis-Bacon Act, the Contract Work Hours and Safety Standards Act, and all related acts (collectively “Federal Labor, Wage and Hour Requirements”).
In accordance with the applicable Federal Labor, Wage and Hour Requirements, the contractor will need to pay not less than the local prevailing rate of per diem wages and local prevailing rates for holiday and overtime work, as determined by the Federal Department of Labor. Notwithstanding the foregoing, if both Federal and State prevailing wage requirements contain the same work classification, then the contractor will need to pay not less than the greater of the two (2) applicable local prevailing rate of per diem wages and local prevailing wage rates for holiday and overtime work.
This is also a “public works” project as defined in Section 1720 et seq. of the California Labor Code (collectively “State Wage, Hour and Labor Requirements”), requiring the payment of prevailing wages, the training of apprentices and compliance with other applicable requirements. This includes construction, demolition, repair, alteration, maintenance, and the installation of photovoltaic systems under a Power Purchase Agreement when certain conditions are met under Labor Code Section 1720.6. This include service and warranty work on public buildings and structures. Contractors and all subcontractors who perform work on the project are required to comply with these requirements to the extent that such requirements do not conflict with the Federal Wage, Hour and Labor Requirements and to the extent the Federal Wage, Hour and Labor requirements are not otherwise applicable. In the event of a conflict between Federal and State wage rates, the higher of the two will prevail.
Disadvantaged Business Enterprise (DBE) Program. The DBE goal percentage established for the project is 21%.
DIR Registration Requirements. All contractors and subcontractors have been required since April 1, 2015 to be registered with the Department of Industrial Relations (DIR). No contractor or subcontractor may be listed on a bid proposal or may work on a public works project unless registered with DIR.
Deposit of Securities in Lieu of Retention. For any moneys earned by the Contractor and withheld by the Town to ensure the performance of the contract, the Contractor may, at the Contractor's request and expense, substitute securities equivalent to the amount withheld in the form and manner and subject to the conditions provided in Article 8, (commencing with Section 10263), Chapter 1, Part 2, Division 2 of the Public Contract Code of the State of California.
Federal Grant Requirements. This project is partially funded by Federal Grant funds and is subject to Federal Grant requirements and the “Buy America” provisions of the Surface Transportation Assistance Act of 1982 as amended by the Intermodal Surface Transportation Efficiency Act of 1991.
Certified Payroll. All contractors and subcontractors must furnish electronic certified payroll records directly to the Labor Commissioner (aka Division of Labor Standards Enforcement). For additional information, visit the DIR website at: http://www.dir.ca.gov/Public-Works/PublicWorks.html.
Bond Requirements. Each bid must be accompanied by a cashier's check, certified check, or Bidder's Bond executed by a corporate surety authorized to engage in such business in the State of California, payable to the Town of Los Gatos, in an amount not less than ten percent (10%) of the amount of the Base Bid. The successful bidder will be required to furnish a Performance Bond in an amount equal to one-hundred percent (100%) of the contract price, and a Labor and Material Bond in an amount equal to one-hundred percent (100%) of the contract price. Said bonds shall also be executed by a corporate surety authorized to engage in such business in the State of California and be made payable to the Town of Los Gatos or shall name the Town of Los Gatos as beneficiary. A pdf copy of the original Bidder’s Bond with surety seal, cashier’s check or certified check must accompany the bid and the original Bidder’s Bond with surety seal, cashier’s check or certified check must be delivered to the Town within 24 hours after bid opening.
If the successful bidder fails, neglects, or refuses for TEN (10) calendar days after the award of the contract to enter into the contract to perform the work, the cashier's check, certified check, or Bidder's Bond accompanying the bid and the amount therein named, shall be declared forfeited to the Town and shall be collected by it and paid into its general fund. No bidder may withdraw his/her bid for a period of ONE HUNDRED TWENTY (120) calendar days after the date set for the opening thereof, and the same shall be subject to acceptance by the Town during this period.
The Town reserves the right to reject any or all bids, waive any irregularities in any bids and its determination as to which bid is the lowest responsible bid and is for the best interest of the Town shall be final. The Town shall have ONE HUNDRED TWENTY (120) calendar days from and after the opening of the bids within which to make its determination.
The Contractor receiving the award of the contract shall begin work within FIFTEEN (15) calendar days after receipt of the Notice to Proceed and shall diligently prosecute the same to completion within the time restrictions as listed in the technical specifications and all work shall be completed by the time allotted in the technical specifications.
The Contractor shall have Two-Hundred Seventy (270) working days to complete this project. Working days will be counted upon the Contractor’s receipt of the Notice to Proceed, as noted above.
Contractor’s License Requirements. At the time of Contract award through Contract acceptance, the Contractor shall possess a valid Class A California General Contractor's License. The Contractor shall also possess a valid Town of Los Gatos Business License at the time the contract is awarded.
Apprentices. Attention is directed to Sections 1777.5, 1777.6 and 1777.7 of the California Labor Code and Title 8, California Administrative Code, Section 200 et seq. to ensure compliance and complete understanding of the law regarding apprentices. Contractors and subcontractors shall comply with all such requirements concerning the employment and wages of apprentices. Bidder/contractor is responsible for the compliance of its subcontractors with California Labor Code Sections 1777.5, 1777.6 and 1777.7.
Nondiscrimination/Non-Preferential Treatment. The Town of Los Gatos hereby notifies all bidders that it will affirmatively insure that the contract entered into pursuant to this advertisement will be awarded to the lowest responsible bidder without discrimination on the grounds of race, color, national origin, sex, religion, age or disability. The Contractor or subcontractor shall not discriminate on the basis of race, color, national origin, or sex in the performance of this contract. The contractor shall carry out applicable requirements of 49 CFR, Part 26 in the award and administration of DOT-assisted contracts. Failure by the Contractor to carry out these requirements is a material breach of this contract, which may result in the termination of this contract, or such other remedy as recipient deems appropriate.
Determination of Low Bid. All bids will be compared on the basis of the Bid Form of quantities of work to be done. The determination of the low bid will be based on the total base bid plus additive alternative items of work (if any) selected by the Town in the order presented. The contract will be awarded to the lowest responsible bidder meeting the contract requirements.
