2040 General Plan Land Use Element and Community Design Element Referendum

A referendum impartial analysis to refer the Land Use Element and Community Design Element of the 2040 General Plan was submitted to the Town Clerk/Elections Official on July 6, 2022.

Town Attorney approved Impartial Analysis.

The referendum proponent summited petitions on August 16, 2022, and the Town Clerk performed a prima facie count. There were 159 petitions with 3,417 signatures which exceeded the minimum requirement for signatures from 10% of the total registered voters in the Town of Los Gatos (2,198). The petitions have been delivered to the Santa Clara County Registrar of Voters Office for signature verification.

The Santa Clara County Registrar of Voters Office (ROV) completed the examination of the referendum petitions. The ROV examined 500 random signatures and verified total number of valid signatures was 445. Based on this number the petition has a projected number of 2,961 (134.7%) estimated valid signatures.  Per Election Code Section 9115, subdivision (b), the statistical sampling meets the minimum number of signatures requirement of 2,198 and the statistical sampling is over 110 percent. The Elections Official has certified the petition meets the 10% valid signature requirement of registered voters to place the referendum on the ballot for consideration by the voters.
