Draft Tobacco Retail Ordinance Workshop

The Town of Los Gatos will be holding a public workshop on the draft Tobacco Retail Ordinance on April 12, 2017 at 5:30 p.m. The Town Council will also hold a public hearing on May 2, 2017 at 7:00 p.m. Meetings will be held in the Town Council Chambers at 110 E. Main Street, Los Gatos.

A Tobacco Retail License (TRL) Ordinance is designed to encourage responsible tobacco retail practices since the California state tobacco retail licensing law is insufficient in reducing illegal tobacco sales to minors. Towns and cities within California have the ability to adopt an additional local TRL ordinance and there are currently 124 towns, cities, and counties within California who have adopted local TRL ordinances including Campbell, County of Santa Clara, Gilroy, Morgan Hill, San Jose, and Saratoga.

A draft Ordinance has been prepared by the Town Attorney’s Office that includes the following components:

• Requires all establishments selling tobacco products to obtain a TRL from the Town.
• Requires an annual license renewal.
• Requires an annual inspection of the premises for compliance with the requirements.
• Requires TRL be displayed in a publicly visible location at the licensed location.
• Prohibits the sale or transfer of tobacco products to anyone under the age of 21.
• Prohibits a person under the age of 21 to engage in tobacco retailing.
• Prohibits all self-service displays of tobacco products.
• Prohibits the sale of flavored tobacco products.
• Prohibits the sale of tobacco products in pharmacies.
• Prohibits new tobacco retailing within 1,000 feet of a school, parks, and playgrounds.
• Prohibits any new tobacco retailers within 500 feet of another tobacco retailer.
• Includes fines for permit violations.
• Allows for a process for license suspension and revocation for violations.
